Terms and Conditions

1. Seller and scope

These Terms and Conditions govern purchases through koreanlashlift.ca. The seller is APC Commerce LLC, trading through the AURA Monaco and Korean Lash Lift brands, 3833 Powerline Road, Suite 301-M, Fort Lauderdale, Florida 33309, United States. Contact email: hello@beamlight-lashes.com. WhatsApp messaging: +33 (0) 7 56 92 34 30. We do not offer telephone support.

The registered business address is not a returns address. Physical orders are fulfilled from Brampton, Ontario. A return sent to an unapproved address may not reach the fulfilment team. Follow clause 11 and the Return and Cancellation Policy before sending anything.

These terms apply with the product page, cart and checkout summary, order confirmation, Return and Cancellation Policy, Privacy Policy, Shipping Information and any specific promotion or guarantee terms displayed before purchase. A later website change does not alter an already accepted order. Mandatory federal or provincial rights prevail where they cannot lawfully be excluded.

2. Consumer and Business Customer status

A Consumer is an individual buying primarily for personal, family or household purposes. A Business Customer is a person buying primarily for a trade, profession or business, including a salon, lash artist, practitioner, academy, distributor or reseller.

A Business Customer confirms that the buyer has authority to bind the business identified in the order and that the business provisions in these terms apply. The actual purpose of the purchase determines status. A company name, commercial delivery address, professional product selection or tax information may be evidence of business purpose but does not remove rights that mandatory law gives to a genuine Consumer.

You must have reached the age of majority in your province or territory and have legal capacity to place an order or open a course account.

3. Products and professional responsibility

The description, quantity, price, ingredients and material specifications displayed for a product at the time of order form part of the contract. Product images are illustrative. Colour, printing, batch presentation and non-material packaging details may vary. We may correct an obvious description, stock or pricing error before accepting the order.

Products identified for professional use must be bought and used by an appropriately trained person. The purchaser must follow the current label, ingredient information, warnings, patch-test requirements, processing times, storage conditions and treatment instructions. The purchaser is responsible for client consultation, contraindication screening, lawful professional use and suitable treatment records.

Results vary with technique, lash condition, processing time, environment, storage and client factors. Product and course content is educational and does not replace medical advice, a safety assessment or professional training. Unless a separate written commercial guarantee expressly says otherwise, we do not promise a particular treatment, financial or business result.

Business Customers must not relabel, decant, alter, counterfeit, reverse engineer or resell products outside original authorised packaging unless a separate written distribution agreement permits it. They must not make unauthorised safety, health, performance or regulatory claims.

4. Accounts and security

You must provide accurate current information, protect your login credentials and restrict access to your account. Notify us promptly of suspected unauthorised use. We may require reasonable identity, address, payment or professional-status verification for security, fraud prevention and lawful supply.

We may temporarily suspend an account or course access while investigating suspected fraud, chargeback abuse, credential sharing, copying, infringement or material breach. Access will be restored where the concern is resolved and no continuing ground for suspension remains.

5. Prices taxes and payment

Prices are displayed in Canadian dollars unless clearly stated otherwise. Applicable sales taxes, delivery charges and other amounts are shown in the cart or checkout before the order is submitted. We do not add a hidden mandatory non-government fee to make an advertised product price unattainable.

Available payment methods are displayed at checkout. Payment must be authorised and cleared. Payment providers may perform identity, address, sanctions and fraud checks under their own terms and privacy notices.

We may reject or cancel an order before acceptance if payment is not authorised, required verification is not completed, information is materially inaccurate, a price or stock error is obvious, quantities are abnormal, supply would be unlawful, or fraud, abuse or unauthorised resale is reasonably suspected. If we cancel after taking payment and no supply has occurred, we refund the amount taken for the cancelled item.

6. Order review contract formation and records

The website listing is an invitation to order. Your submitted order is an offer to buy. Before submission, the checkout provides an opportunity to review the items, quantities, price, taxes, delivery charge, address and other information and to correct errors.

An automated acknowledgement confirms receipt. A contract is formed when we send a dispatch confirmation, provide paid digital access, or otherwise expressly accept the order. We may accept or reject items separately.

The order confirmation and these terms form the written contract record. Save them for your records. For a Consumer internet agreement, the confirmation will include or provide retainable access to the information required by applicable law. If required information, an error-correction opportunity or a compliant contract copy is missing, the Consumer may have statutory cancellation rights that these terms do not limit.

7. Delivery

Physical orders are fulfilled from Brampton, Ontario and delivered with Purolator or Canada Post. The available service, delivery charge and current estimate are shown at checkout. Unless expressly identified as guaranteed, dispatch and delivery dates are estimates. Weekends, holidays, payment or address checks, severe weather, carrier disruption and events outside our reasonable control may affect them.

You must provide a complete and accurate delivery address. Where a parcel is returned because the address supplied was incomplete or incorrect, delivery was refused, or collection was not completed, we may require payment of reasonable return and redelivery costs or deduct them from a voluntary refund. A statutory Consumer refund is reduced only where applicable law permits.

For a Consumer, risk normally passes when the Consumer or the Consumer's authorised recipient takes possession, subject to applicable law. For a Business Customer, risk passes when we hand the goods to the carrier. Title does not pass until all amounts due for the goods have been paid.

Mandatory rights for excessive late delivery remain unaffected. Acceptance of delivery after a statutory late-delivery cancellation period may affect a cancellation right where the applicable law provides.

8. No general change-of-mind right

Canadian law does not provide a universal change-of-mind return right for ordinary retail goods. Except where mandatory law applies or we expressly agree otherwise in writing, all sales are final and we do not accept returns or exchanges for change of mind, mistaken selection, over-ordering, dislike of colour or packaging, client cancellation, lack of demand, failure to read the product description, or dissatisfaction that is not caused by a defect or material misdescription.

Opened, unsealed, used, tested, mixed, altered, contaminated, incomplete or damaged beauty products are not eligible for a voluntary return. This rule protects product safety and reflects the loss of resale value. It does not remove a Consumer remedy for a genuine defect, material misdescription, incorrect item or other mandatory statutory ground.

9. Consumer statutory rights

Nothing in these terms excludes or limits a Consumer right that cannot lawfully be excluded. Depending on the province or territory, goods may carry implied or statutory conditions or warranties relating to title, description, acceptable or merchantable quality, durability, safety and fitness for a disclosed purpose.

Ontario Consumers may have internet-agreement cancellation rights where prescribed information was not properly disclosed, the checkout did not permit acceptance, rejection and correction of errors, a compliant written agreement was not supplied within the required time, or delivery is more than 30 days late. Consumers in Québec and other provinces may have similar or additional mandatory rights. A general request to change an order is not itself a statutory cancellation ground.

10. Damaged incorrect or allegedly defective goods

Inspect the parcel promptly. If reasonably possible, notify us within 48 hours of visible carrier damage, shortages or an incorrect item and retain the shipping carton, label and contents. This prompt notice helps us investigate the carrier claim but does not extinguish a mandatory Consumer right.

For an alleged defect, contact hello@beamlight-lashes.com before disposal or further use. Provide the order number, product and batch information, clear photographs or video, a description of storage and use, and other information reasonably needed to assess the claim. We may require the affected product to be returned and may provide a prepaid label where the claim is potentially valid.

A remedy is not due for damage or failure caused by incorrect storage, expired use after delivery, contamination, mixing with incompatible products, alteration, accidental damage, disregard of instructions, incorrect processing, contraindications or unqualified application. Where a defect or non-conformity is established, the available remedy may be repair, replacement, supply of the missing or correct item, price reduction, credit or refund as required by applicable law.

11. Returns process

Before returning an item, submit the form at koreanlashlift.ca/returns or contact hello@beamlight-lashes.com and wait for written instructions and the correct Ontario return address. Do not send a parcel to the Florida registered address.

Prior authorisation is required for every voluntary return. A Consumer may exercise a statutory cancellation right by any valid notice permitted by applicable law; the form is not used to defeat that right. Unauthorised voluntary returns, cash-on-delivery parcels and parcels sent to an unapproved address may be refused.

The customer bears shipping cost and transit risk for a voluntary return. We bear reasonable return cost where mandatory law requires or where we confirm a defective or incorrect supply claim. Use protective packaging and retain tracking and proof of delivery.

Approved refunds are issued to the original payment method unless law requires otherwise. We may wait until returned goods arrive or sufficient evidence of return is supplied where applicable law permits. Payment-provider processing time is outside our control.

12. Business Customer claims and remedies

Business Customers have no cancellation, exchange or return right for convenience. Any commercial return is entirely discretionary and must be authorised in writing. An authorised item must arrive within the stated period, unused, unopened, complete, uncontaminated and in fully resalable original packaging. The Business Customer bears carriage and transit risk. We may deduct original and return delivery costs, irrecoverable payment fees and reasonable inspection, administration, repacking and loss-of-value costs.

A Business Customer must inspect immediately. Visible damage, shortage or incorrect supply must be reported in writing within two business days after delivery with photographs of the parcel, label and contents. A latent alleged defect must be reported promptly after discovery. To the fullest extent lawful, failure to give timely notice is acceptance for that visible issue.

For a valid Business Customer claim, our exclusive contractual remedy, at our option, is repair, replacement, supply of a missing quantity, account credit or refund of the affected goods. The Business Customer must give us a reasonable opportunity to inspect and remedy the issue before obtaining substitutes or incurring third-party costs.

To the fullest extent permitted by law, all conditions, warranties and terms implied by statute, common law, usage or course of dealing, including merchantability, fitness for purpose and quality, are excluded from Business Customer contracts. Title and any liability that cannot lawfully be excluded are not excluded.

13. Courses and digital content

Paid course access is a personal, limited, revocable and non-transferable licence for the period stated on the product page. Login credentials, video, text, photographs, downloads, assessments and teaching materials must not be shared, copied, recorded, scraped, republished, resold, used to train competing materials or made available to another person. Certificates are issued only when published completion and assessment conditions are met.

Except where mandatory law provides otherwise, digital course and content sales are final and non-refundable once access credentials or content are supplied. Failure to log in, begin or complete the course does not create a refund right where functioning access was supplied. Contact support promptly if a technical access problem occurs so that we can investigate and restore access.

Providing digital access does not automatically determine rights relating to a physical product in the same bundle. We may allocate a bundle refund between physical and digital components using the price or reasonable allocation disclosed before purchase, subject to mandatory law.

We may suspend or terminate access for credential sharing, copying, infringement, unlawful use, payment reversal or material breach. Where suspension was an error or a payment dispute is resolved in the customer's favour, we restore the access still due.

14. Commercial guarantees promotions and reviews

A commercial guarantee applies only when the relevant product page expressly offers it and states its conditions before purchase. A 14-day support or results-assistance statement is not a blanket 14-day return entitlement. Any commercial guarantee is additional to mandatory Consumer rights.

Promotions and discount codes apply on the displayed conditions. Unless stated otherwise, codes cannot be combined, have no cash value, apply only to eligible products and may be withdrawn for future orders. We may reject manifest pricing or discount errors before acceptance. Sale and savings claims refer to the comparison identified in the offer.

Reviews must reflect genuine experience. If you submit material for publication, you confirm that you own it or have permission to provide it. Any licence for marketing use will be stated when the material is requested. Evidence sent privately for support or a claim is not licensed for advertising merely because it was submitted.

15. Intellectual property and prohibited use

The website, brands, product designs, photographs, video, text, course materials, downloads and other content are protected by intellectual-property law. No right is granted to reproduce, adapt, distribute, sell, license, scrape or commercially exploit them beyond ordinary use of purchased goods and the limited course licence.

You must not compromise site security, introduce malicious code, scrape protected content, bypass access controls, misuse another person's account, make unlawful claims in our name or use the services in violation of law.

16. Liability to Consumers

We do not exclude liability or remedies that applicable law does not permit us to exclude. Subject to those rights, we are not responsible for loss caused by misuse, incorrect storage, failure to follow instructions, contraindications, unauthorised alteration, unqualified application, inaccurate customer information or events outside our reasonable control.

We are not responsible for business loss claimed by a Consumer. We do not promise uninterrupted website availability, but this does not affect an accepted order or a paid access obligation that must be performed.

17. Liability to Business Customers

This clause applies only to Business Customers. Nothing excludes liability for fraud, wilful misconduct, title to goods or any liability that cannot lawfully be excluded.

Subject to those exceptions, APC Commerce LLC is not liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, revenue, savings, goodwill, reputation, bookings, clients, opportunity or data; business interruption; wasted management time; substitute purchase costs incurred without a reasonable opportunity to remedy; or third-party claims arising from the Business Customer's treatment or resale.

Our total aggregate liability arising from or connected with an order, whether in contract, tort, negligence, misrepresentation, restitution, statute or otherwise, is limited to the amount paid for the affected order. Each exclusion and limitation operates separately and only to the fullest extent permitted by applicable law.

18. Business Customer indemnity

A Business Customer must indemnify APC Commerce LLC and its affiliates against third-party claims, losses and reasonable legal costs arising from the Business Customer's relabelling, decanting, unauthorised claims, unlawful resale, negligent treatment, failure to assess contraindications, use contrary to instructions, intellectual-property infringement, credential sharing or breach of clause 13. This indemnity does not cover loss caused by our fraud or wilful misconduct and applies only to the lawful extent.

19. Events outside reasonable control

We are not liable for delay or failure caused by events outside reasonable control, including carrier disruption, severe weather, industrial action, utility or communications failure, cyber incidents not caused by our failure to use reasonable security, government action, import restrictions, epidemic, fire or natural disaster. We will take reasonable steps to reduce the effect and resume performance. Mandatory rights relating to excessive delay remain unaffected.

20. Governing law disputes and Québec rights

These terms and Business Customer contracts are governed by the laws of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Business Customers submit to the exclusive jurisdiction of the courts of Ontario.

A Consumer retains the mandatory protection of the province or territory in which the Consumer resides and may use a court or complaint process that has mandatory jurisdiction. Nothing in this clause requires a Consumer to waive a class-proceeding, access-to-court, Québec-language or other non-waivable right.

21. General terms

If a provision is invalid or unenforceable, it is severed or limited to the minimum extent necessary and the remaining provisions continue. A delay in enforcing a right is not a waiver. You may not assign a course licence or order right without our written consent. We may assign the contract as part of a genuine business transfer if this does not reduce a Consumer's mandatory rights.

Changes to these terms apply prospectively from publication unless a change is required by law. The version accepted for an existing order continues to govern that order. These terms, the documents incorporated in clause 1 and any express written acceptance form the entire contract, subject to mandatory law and liability for fraud or misrepresentation.
